Terms and Conditions
By using our services, you agree to be bound by these terms and conditions. Each of the paragraphs of these Terms & Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs remain in full force and effect. These Terms & Conditions are governed by English law.
If you should be unsatisfied with the products or services, EBW Embroidery will at their discretion, may attempt to resolve the issue in your favour. Any offer(s) made may be revoked and will not replace the terms and conditions of business.
Definitions:
Any reference to ‘we’, ‘us’ or ‘our’ refers to EBW embroidery also known and Embroidered Banners & Workwear, which is owned and run by Mark Denman, Swindon, Wiltshire.
Any reference to ‘you’ or ‘your’ relates to the user and/or purchaser of our services.
‘Personalised services’ and ‘personalised products’ relate to any item with a bespoke modification, such as embroidery, printed or tailored modifications These are considered Bespoke Goods under the relevant legislation. A standard product is an unmodified product.
Data protection:
Personal information will only be collected, used, and stored to enable the delivery of our services and for us to comply with current legislation. Data will not be transferred or sold to third parties unless required by law. This means that information and data may be deleted after 30 days following the completion of the service.
Delivery and Returns:
We will use an appropriate courier to deliver your products. The order will be sent to the address you have supplied. You will be liable for any losses due to any errors in the address given. However, we will seek to help in the recovery of the package should it be delivered to an incorrect address.
The quantity of any consignment of Goods as recorded by EBW Embroidery upon despatch from our place of business shall be conclusive evidence of the quantity received by the Buyer on delivery unless the Buyer can provide conclusive evidence proving the contrary (such evidence shall not include witness evidence from any of the Buyer's employees).
We shall not be liable for any non-delivery of Goods (even if caused by our negligence) unless the Buyer gives written notice to us of the non-delivery within days of the date when the Goods would in the ordinary course of events have been received.
Any liability of us for non-delivery of the Goods shall be limited to replacing the Goods within a reasonable time or issuing a credit note at the pro rata Contract rate against any invoice raised for such Goods.
If for any reason the Buyer fails to accept delivery of any of the Goods when they are ready for delivery, or our chosen currier is unable to deliver the Goods because the Buyer has not provided appropriate instructions, documents, licences or authorisations the risk in the Goods shall pass to the Buyer and the Goods shall be deemed to have been delivered.
You have 14 days from receipt of the items to return any standard product that does not meet your satisfaction. These items should be unused and a resaleable condition. The liability of returning the item remains with you. Personalised products may not be returned unless faulty. Please ensure that the spelling of words are correct as this cannot be changed once manufacturing begins. If we detect what we believe are errors, we will attempt to contact you for clarification. If we are unable to contact you within a reasonable timeframe we will proceed with the order as requested or cancel it at our discretion.
Personalised services:
Embroidery resolution is not the same as a Jpeg image. Depending on the complexity of the image details may have to be modified. If the change is significant, we may produce a sample prior to completing your order. In all cases reasonable care and attention will be given to the services offered.
Unless stated there will be a minimum of 12 hours from placing the order before production commences. This is to allow for you to correct any errors you may have made in uploading files.
Copyright:
Copyright remains with the copyright holder. You agree that you are authorised to use any image you requested to be embroidered, printed or otherwise created. Furthermore, you accept liability for any copyright infringement for the orders you place. We retain the copyright to the embroidery files created from your artwork.
Images may not be copied from our website or other literature without express written permission from EBW Embroidery.
We reserve the right to refuse any order that we believe infringes on a third parties copyright unless you can prove you have the right to use those images. We also reserve the right to refuse orders that we believe could cause harm, distress or may be used in an unlawful manor.
We remain bound by the Terms and Conditions of the software and licences we use with the manufacturers and service providers.

Textile care:
Embroidered items are best washed below 65°C (140°F) using mild detergent with no chemical additives. Damp embroidered items should not be left pressed against other items.
Ensure the item is well rinsed before tumble drying. Iron from the reverse side.
If in the unlikely situation that dye is released into the water, continue to rinse until the water runs clear. Avoid using bleach or other discolouring agents as these may cause irreversible staining. Avoid storing in bright sunlight to prevent fading.
A well cared for embroidery should last many years with minimal fading.
